2. Description of Service

YouthBaseballTryouts.com provides a directory and listing service for youth baseball and softball tryouts across the United States. We connect teams, coaches, and organizations with parents and players seeking tryout opportunities.

3. User Accounts

To list tryouts or access certain features, you may need to create an account. You are responsible for:

Maintaining the confidentiality of your account information
All activities that occur under your account
Notifying us immediately of any unauthorized use
Providing accurate and current information

You must be at least 18 years old, or have a parent or legal guardian's consent, to create an account or post listings. If you create an account on behalf of a team or organization, you represent that you have authority to do so and accept financial responsibility for any paid services associated with the account.

4. Listing Content

When you submit a tryout listing, you represent and warrant that:

You have the authority to post the listing
All information provided is accurate and truthful
Your listing does not violate any laws or third-party rights
You will update information as needed to maintain accuracy

Each paid listing covers a single tryout window as described during purchase. Listings that include tryouts more than the allowed number of days beyond the initial date may be rejected or require additional payment. We reserve the right to review, edit, or remove any listing at our discretion.

5. Prohibited Activities

You agree not to:

Post false, misleading, or fraudulent information
Impersonate any person or entity
Use the Site for any illegal purpose
Transmit viruses, malware, or harmful code
Scrape, harvest, or collect user data without permission
Interfere with the proper functioning of the Site
Violate any applicable laws or regulations

6. Intellectual Property

All content on this Site, including text, graphics, logos, and software, is the property of YouthBaseballTryouts.com or its licensors and is protected by copyright and other intellectual property laws. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YouthBaseballTryouts.com SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11. Indemnification

You agree to indemnify and hold harmless YouthBaseballTryouts.com, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Site or violation of these Terms.

12. Subscription Plans

12.1 Plan Types

YouthBaseballTryouts.com offers the following subscription plans:

Free Plan: 1 tryout session per rolling 365-day period, no featured placements
Club Plan ($20/year): Unlimited tryout sessions, enhanced club profile features
Featured Club Plan ($50/year): Unlimited tryout sessions, enhanced features, plus 1 featured placement per month

A "session" is defined as one tryout for one age group at a specific date and time. Multiple age groups on the same day count as separate sessions.

12.2 Session Limits

Free plan users are limited to posting 1 tryout session per rolling 365-day period. Attempting to exceed this limit will require upgrading to a paid plan. Club and Featured Club plans offer unlimited tryout sessions, subject to our fair use policy.

12.3 Featured Placements

Featured Club plan includes 1 featured placement per calendar month (12 per year). Monthly credits do not roll over to subsequent months. Featured placements provide priority positioning on homepage and state pages for maximum visibility. Featured placements are subject to our approval and editorial discretion. We reserve the right to remove featured placements that violate our content policies.

Club plan users may purchase featured placements à la carte at the then-current rate. À la carte featured placements are typically 30 days in duration.

12.4 Fair Use Policy

While Club and Featured Club plans offer "unlimited" tryout sessions, we reserve the right to limit excessive use that impacts service performance, violates the spirit of fair use, or appears to be automated or abusive. We will provide notice before taking action on accounts suspected of violating fair use.

13. Payment & Billing Terms

13.1 Payment Processing

All payments are securely processed through Stripe, Inc. ("Stripe"). By subscribing to a paid plan, you agree to Stripe's Services Agreement (https://stripe.com/legal) and authorize us to charge your payment method on file. We do not store your credit card information on our servers.

13.2 Subscription Charges

Paid plans are billed annually in advance. You will be charged the subscription fee at the time of purchase and on each annual renewal date thereafter. All fees are stated in U.S. Dollars and are non-refundable except as expressly stated in these Terms.

13.3 Automatic Renewal

IMPORTANT: YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW AT THE END OF EACH ANNUAL BILLING PERIOD UNLESS YOU CANCEL BEFORE THE RENEWAL DATE. YOU WILL BE CHARGED THE THEN-CURRENT RATE FOR YOUR PLAN. You authorize us to charge your payment method on file for renewal charges. You can cancel auto-renewal at any time from your account billing settings.

13.4 Price Changes

We reserve the right to change our subscription pricing with at least 30 days advance notice. Price changes will take effect at your next renewal date. We will notify you of any price changes via email. Continued use of the service after a price change constitutes acceptance of the new price. If you do not agree to a price increase, you may cancel your subscription before the renewal date.

13.5 Failed Payments

If your payment method fails or your account has insufficient funds, we will attempt to collect payment again. If payment cannot be collected after multiple attempts, your account may be downgraded to the Free plan. You are responsible for keeping your payment information current and ensuring sufficient funds are available for renewal charges.

13.6 Taxes

All fees are exclusive of applicable federal, state, local, or foreign taxes. You are responsible for paying all taxes associated with your subscription. If we are required to collect taxes, they will be added to your invoice.

14. Cancellation & Refunds

14.1 Cancellation

You may cancel your subscription at any time from your account billing settings or by contacting customer support. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the end of the period you have paid for. No refunds will be issued for the unused portion of your subscription period.

14.2 Refund Policy

Annual subscriptions are non-refundable. We do not provide refunds or credits for:

Partial subscription periods
Unused featured placement credits
Downgrading to a lower-tier plan
Accounts canceled mid-period

Refunds may be issued at our sole discretion in exceptional circumstances, such as verified duplicate charges or billing errors, within 7 days of the charge. To request a refund, contact us at frontoffice@youthbaseballtryouts.com.

14.3 Plan Changes

Upgrades: If you upgrade to a higher-tier plan, the upgrade takes effect immediately and you will be charged the prorated difference for the remainder of your billing period.

Downgrades: If you downgrade to a lower-tier plan, the change takes effect at the end of your current billing period. No refunds or credits will be issued for downgrading. Your content may be limited based on the restrictions of your new plan.

15. Account Suspension & Termination

We reserve the right to suspend or terminate your account and access to the Site at any time, with or without notice, for any reason, including:

Violation of these Terms of Use
Fraudulent or illegal activity
Outstanding payment obligations
Excessive or abusive use of the service
Posting prohibited or harmful content

If your payment fails and cannot be collected, your account may be automatically downgraded to the Free plan. Upon account termination, you will lose access to paid features immediately. We may retain certain information (such as payment records, listing history, and user data) for legal, accounting, security, and fraud-prevention purposes as described in our Privacy Policy.

You may terminate your account at any time by canceling your subscription and contacting us to request account deletion. Account deletion is permanent and cannot be undone.

16. Data Privacy and Communications

By creating an account or submitting a listing, you consent to the collection and processing of your information in accordance with our Privacy Policy. You consent to receive emails and notifications related to your account, subscriptions, and listings, including billing reminders and renewal notices. You may opt out of marketing emails at any time, but you cannot opt out of transactional emails related to your account and subscription.

17. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located within Missouri, and you consent to their jurisdiction.

18. Modifications to Terms

We may update these Terms of Use from time to time. We will notify users of material changes by posting the updated terms on this page with a new "Last Updated" date and, for subscription-related changes, via email. Your continued use of the Site after changes constitutes acceptance of the modified terms.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

20. Entire Agreement

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and YouthBaseballTryouts.com regarding the use of the Site.
